The Court system is designed to encourage settlement at an early stage and a realistic approach and assessment of likely fees at an early stage.
The main objective of civil litigation is to obtain payment of money due under a contract or damages.
Cases are split. Those below £5,000 proceed under the “Small Claims Track”. Under this procedure the Courts expect that the parties will manage without Lawyers. The procedures will be relatively simple. A typical case will probably take 45 minutes for the Judge to hear and deal with.
We can still advise on cases in the Small Claims Track but seek where possible to give you guidance and steer you in the right direction so that you can take the case yourself through the system without incurring significant costs.
Contract cases can include claims for unpaid invoices for work or goods, dispute about building works or services and injury claims.
